Terms of Service

These Terms of Service (“Terms”) govern your access to and use of WudaokouApartments.com (the “Site”) and any related information or assistance we provide through email or WeChat (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

We can be reached at hello@wudaokouapartments.com. We do not provide phone support.

1) Our Services

  • We help users discover rental options in Wudaokou(五道口) and other parts of Beijing, arrange viewings, coordinate with property managers/owners, provide general guidance on leases, and assist with practical steps like local address registration coordination (when requested).
  • We are not a landlord, property owner, or property manager. We do not provide legal, tax, immigration, or visa advice. Any information we share is general; you should obtain professional advice where needed.
  • Listings (photos, pricing, availability, unit features) are provided by third parties and may change at any time. You are responsible for verifying details before making decisions.

2) Eligibility

  • The Services are intended for individuals 18 years or older. By using the Services, you confirm you are at least 18 and have capacity to enter binding agreements.

3) Your Responsibilities

  • Provide accurate and complete information (e.g., budget, dates, documents).
  • Use the Services lawfully; do not attempt to disrupt, scrape, copy at scale, or misuse the Site.
  • You are responsible for your decisions and for reviewing any lease or written agreement directly with the owner/manager.

4) No Brokerage/Lease Guarantee

    • We act as an intermediary to facilitate introductions and viewings. We do not guarantee approval, pricing, lease terms, move-in dates, repairs, or building services. All final terms are between you and the property owner/manager.
  • We do not warrant that a given listing will remain available or that any application will be accepted.

5) Referrals, Partner Introductions & Compensation

  • If you look outside our core area (e.g., Sanlitun, Chaoyang, Guomao) or request related services (e.g., movers, cleaning, internet setup), we may introduce you to another agency or service provider and share the minimum information needed to help you.
  • We may receive a referral fee for some introductions. After an introduction, the third party handles your information under their policies and terms. See our Privacy Policy for details and your choices.

6) Fees and Separate Agreements

  • Any agency fee, deposit structure, payment schedule, or other commercial terms are set out in a separate agreement (for example, an agency service agreement or a lease/booking document). These Terms do not change those terms.
  • Where there is a conflict, the signed agreement you enter for a specific rental or service controls.

7) Police Registration & Compliance

  • Address registration (住宿登记) obligations are set by local law. We may help coordinate documents or scheduling, but you remain responsible for completing required steps on time. We are not liable for fines or penalties.

8) Intellectual Property

  • The Site and its content (text, graphics, logos, design, and layout) are protected by law. You may view and print pages for personal use related to the Services.
  • You may not copy, scrape, republish, or distribute Site content for commercial use without our prior written consent.

9) User Submissions & Communications

  • If you email or message us (questions, criteria, documents), you grant us a non-exclusive license to use that information to provide the Services and to comply with law.
  • You must have the right to share any documents you provide. Do not send unlawful, defamatory, or infringing content.

10) Third-Party Sites & Services

  • The Site may link to third-party sites or services (e.g., mapping, universities, building managers, partner agencies). We do not control and are not responsible for their content, practices, or agreements. Your dealings with third parties are solely between you and them.

11) Privacy

  • Our Privacy Policy explains how we collect, use, share, and protect information, including analytics and referrals. By using the Services, you also agree to the Privacy Policy.

12) Disclaimers

  • THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • We do not guarantee the accuracy or completeness of listings, translations, availability, or timelines. Internet and platform outages may occur.

13) Limitation of Liability

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY.
  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT OF FEES YOU PAID TO US FOR THE SPECIFIC SERVICE IN THE 12 MONTHS BEFORE THE CLAIM (OR USD $100, WHICHEVER IS GREATER).
  • Nothing in these Terms limits liability that cannot be limited under applicable law.

14) Indemnity

  • You agree to defend, indemnify, and hold us harmless from claims, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of: (a) your use of the Services; (b) your breach of these Terms; (c) your violation of law or third-party rights.

15) Changes, Availability & Suspension

  • We may update the Services or these Terms at any time. The “Last updated” date reflects the latest version. Continued use after changes means you accept the changes.
  • We may suspend or stop the Services, or block access, at any time for maintenance, security, legal, or business reasons.

16) Electronic Communications & Signatures

  • You consent to receive communications electronically (email/WeChat). Electronic records and signatures related to the Services have the same legal effect as paper versions to the extent allowed by law.

17) Governing Law & Dispute Resolution

  • Governing law. These Terms and any dispute or claim arising out of or relating to them or the Services are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. For clarity, any lease or other agreement you enter into with a property owner/manager is a separate contract between you and that third party and will be governed by the law and venue stated in that third party’s agreement.
  • Informal resolution. Before filing a claim, the parties will first try to resolve it informally for 30 days by emailing hello@wudaokouapartments.com with a description of the dispute.
  • Arbitration agreement. If we cannot resolve a dispute informally, any claim between you and us arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the AAA under its Consumer Arbitration Rules (or, if inapplicable, the Commercial Rules). The seat and venue of arbitration will be Clark County, Nevada, and you may choose to appear by video if permitted by the rules.
  • Class/representative actions. To the fullest extent permitted by law, no class or representative actions are allowed. Arbitration is on an individual basis only.
  • Small claims & injunctions. Either party may bring an individual claim in small claims court in Clark County, Nevada, or seek temporary injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.
  • Court venue (if arbitration is not enforced). If this arbitration clause is found unenforceable as to a particular claim, that claim will be heard exclusively in the state or federal courts located in Clark County, Nevada, and the parties consent to those courts’ jurisdiction.
  • Time limit. Any claim must be filed within one (1) year after it arose, or it is permanently barred, to the extent permitted by law.
  • Consumer protections. Nothing in this Section limits non-waivable consumer rights under applicable law.

18) Severability; No Waiver; Assignment

  • If any provision is held invalid or unenforceable, the remainder stays in effect.
  • Our failure to enforce a provision is not a waiver.
  • We may assign our rights and obligations; you may not assign without our prior written consent.

19) Force Majeure

  • We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., outages, strikes, pandemics, government actions, natural disasters).

20) Entire Agreement

  • These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services, except for any separate written agreement you sign for a specific rental or service, which will control for that transaction.
